The dire consequences of acute  malaise due to massive electoral frauds of ECM 

This is a very important and a critical matter that has plagued the nation for decades and that is official rigging/electoral frauds by none other the Election Commission Malaysia (ECM) or regularly known as SPR.

It is undeniable now as even Tun Dr Mahathir had commented that he noted that some states in Malaysia cannot form their state governments because of "some manipulation".

Using Sabah as an example, he said ally Parti Warisan Sabah (Warisan) is having difficulties to form the state government because the party's seats were reduced from 35 to 29 after a recount by the Election Commission (EC) as well as attempts to woo "some people to cross over using money".

"We regard this as corruption. Malaysian Anti-Corruption Commission seems to ignore the fact that corruption was rife,” he added.

“We will investigate this and adhere to the rule of law.  If we find any evidence of money being used to get votes, we will move to declare the election invalid."

Tun Dr Mahathir was also recorded in You tube of this state of affair of GE 14.

In response to the above, MACC gives undertaking it will investigate all GE14 corruption cases

Then quickly EC Denies Allegations of Manipulation In GE14

EC chairman Tan Sri Mohd Hashim Abdullah stressed that EC had carried out all the processes of GE14 with transparency and fairness, with any manipulations aimed at certain parties.

“The EC had never interfered in all matter, including the counting and tallying of ballot papers,” he said in a statement here today.

After so much had been said especially by the new PM, is any new development coming forth about the investigation on the very much questioned GE14 nationwide and not only in Sabah?  I would strongly suggest that a Royal commission of Inquiry on ECM and GE 14 to be known as RCI on Conduct of GE14.

This would be the first RCI to put to rest all allegations of electoral frauds for decades and that ECM be revamped once and for all to ensure that the Governments formed in future after General Elections would be legitimate.  

We have now witnessed after 60 years of BN/UMNO all the excessive national frauds mainly due to the unbroken reign of BN/UMNO and believed to be beyond repair or redemption.

It is obvious with concrete evidence against ECM since I lodged the Police Report on GE2004 on the official rigging by ECM to keep BN/UMNO in power for so long.

The concrete evidence that surfaced or self exposed in GE2004 was the massive discrepancies found in many seats where the ballot papers were issued to Parliament seats and the respective state seats under the Parliament seats.  The electoral results were published in Gazette and simple analysis would reveal such massive discrepancies in those seats.

For the official results of GE14 (GE 2018) as published in Gazette, Form 16 as a prescribed document under Section Regulation 27 of Elections (conduct of elections) Regulations 1981 was not adhered to hence this electoral frauds was sort of covered up.

The official results for GE2004, GE2008 as per Gazette respectively did comply with Form 16 resulting in the said massive discrepancies of ballot papers issued.  I had done the analysis thereof. 

The official results for GE2013 as per Gazette did not comply with Form 16 but a departed version which I will later show here.  For some seats that still show some - ballot papers issued-discrepancies, a second Gazette (possibly illegal) was published to clear the discrepancies.  How can a single General Election be given two set of results with grievous implication of frauds especially new Governments (Federal and States) were formed on the night of polling based on defective official results and ECM cannot vary the results of the returned polling results by the Returning Officers.

Coming back to Form 16, there are 8 items to be reported and they are as follows in this order:- A =total number of electorate; B= Number of votes by electors for each contesting candidate; C=Total Number of rejected ballot papers; D= Voted Ballot papers in ballot boxes; E=Total ballot papers issued to voters including postal votes; F= number of ballot papers issued but not returned; G=Percentage of voting; H= Majority of votes and this Form 16 as dated was certified and signed by the Returning Officer. 

There is no way we can view such forms such as Form 16, Form 15 and Form 14 which are the source documents of the reported results from the polling and counting centres. So I had to analyse the official results in the Gazette.

In GE2013 and GE2018, the results in Gazette showed the following 7 items as per manipulated Form 16  as follows in this order:- :- A =total number of electorate; B=Total number of ballot papers issued at the polls ; C=Number of votes by electors for each contesting candidate; D=Total Number of rejected ballot papers;  E=Total ballot papers issued but not put in the ballot box ; F= Percentage of voting; G= Majority (the highest votes –  second highest votes) and this manipulated results were a departure from Form 16 as dated was certified and signed by the Returning Officer. 

The omitted item D as per statutory prescribed Form 16 in GE2013 and GE 2018 (7 items instead of 8) namely Voted Ballot Papers in ballot boxes holds the key to the analysis of massive discrepancies of issued ballot papers of Parliament seat and the state seat thereof.  If we can get hold of all Form 14 and Form 15, then we can find the massive discrepancies.  The item B in GE2013 and GE2018 can be manipulated to give zero discrepancies.  That is what the second Gazette for GE2013 did as manipulation for sort of fictitious “errors” thereof.  

I had illustrated the massive discrepancies in my analysis for GE2004 and GE2008 and for GE2004 as published in my book “Malaysian General Election March 2004 –A Case of Victory - landslide or rigslide” in 2007.  I had also lodged Police Reports on GE2004 and GE2008 and filed two High Court cases but was simply struck out by the indifferent judge.  ECM got sort of clever by manipulating Form 16 in GE2013 to avoid detection of massive discrepancies. The Form 16 must not be amended by law to perpetrate the frauds of ECM.

We had a Parliament Select Committee on Electoral Reforms in Nov 2011 headed by Datuk Maximus Ongkili but appeared futile to address the issue on massive discrepancies of ballot papers issued as raised by me there and it was obviously known to the guilty politicians of BN. So we must have a very urgent RCI on Electoral Frauds to revamp all the matters raised at the campaign and voting processes and especially the declared results published in the Gazette according to Form 16 and not as manipulated by ECM in GE14.

Why I am writing within 6 months of 9 May 2018/ 29 May 2018 (Gazette) when the Election court is sitting without fear of “contempt of court”?  Action via RCI must start now within 6 months before ECM destroy most records and documents thereafter.  I doubt if any election court cases in their papers/filing make reference to the corrupted Form 16 and if this is done, there is no need to prolong those few court cases.  I had written about the manipulated Form 16 prior to GE14. This letter should send the right message to the nation to save Malaysia. 

Would the Prime Minister or the Law Minister now make a declaration of the manipulated Form 16 to declare the official results illegal to put to rest all the manipulations of ECM. It is very important and crucial that checks on all the data and documents on GE14 and if not declare GE14 overall as illegal, null and void, at least all those seats (parliament and state ) with massive discrepancies should go through by-elections to save Malaysia from all sort of illegalities which is deemed tsunami of illegalities.

Like it or not, the sort of deceptive “invincibility” of BN/UMNO for decades is criminally  founded on electoral frauds hence it is the root of the exposed national frauds and scams in economy, financial and social malaise.  The new PH Government must stop the electoral frauds immediately without fear or favour for a new Malaysia.
